Developer Contributions & Affordable Housing

Increasingly development is considered to have an impact beyond the boundary of the application site. Developers are now commonly required to provide contributions to the Community by way of conditions attached to the Planning Consent, usually in the form of a Section 75 Agreement in Scotland or Section 106 in England.

We have experience of negotiating a wide range of developer contributions including Affordable Housing, financial contributions to education provision, community centres and public transport, and the provision open space, to name a few.

We will seek to negotiate a level of contributions which is reasonable for the scale and location of the development, using contributions which have been secured from comparable developments, as precedents in our negotiations.

Affordable Housing will remain topical in the current political climate. We have experience of working with Housing Associations and Local Authority Housing Departments to achieve outcomes which are, as far as possible, win-win situations.

Negotiation of developer contributions can be a complex and time consuming process, during which liaison is required with a wide range of parties including Local Authority Departments, Housing Associations and solicitors.

We can offer experience and understanding of the process, and a full appreciation of the implications on the viability of the development. A careful balance is required between the level of Developer contributions and the smooth passage of the Planning Application.
